OpenAI X Giveaway (“Giveaway”) Official Rules (“Rules”)

No purchase or payment is necessary to enter or win. A purchase or payment will not increase your chances of winning. Void where prohibited by law.  This Giveaway is in no way sponsored, endorsed or administered by, or associated with Twitter, Inc. ("X").

Important: Please read these Rules carefully, which are a contract between you and OpenAI (as defined below), before taking any steps to participate. Without limitation, this contract includes indemnities to OpenAI from you and a limitation of your rights and remedies. By participating, you agree to be bound by these Rules and represent that you satisfy all requirements.

To the extent the Giveaway-related communications and these Rules are provided by OpenAI solely in English, OpenAI will have no liability for any issues related to translation of those materials by browsers, apps, or any other mechanism, and the English version of all materials will govern. 

OVERVIEW: The Giveaway begins when OpenAI posts an announcement from its X account @ChatGPTapp inviting eligible individuals to enter the Giveaway (“Giveaway Announcement”) on or about 2:00:01 PM Pacific Time (“PT”) on July 17, 2026 and ends at 11:59:59 PM PT on July 19, 2026 and (“Giveaway Period”). After the Giveaway Period, one (1) potential winner will be selected in a random drawing as more fully described below and will be subject to verification before being confirmed to receive the prize. 

ELIGIBILITY: The Giveaway is open only to individuals who: (1) are at least eighteen (18) and the age of majority under applicable law in their jurisdiction of primary residence as of the start of the Giveaway Period, (2) are a resident of a ChatGPT supported country (full list available: https://help.openai.com/en/articles/7947663-chatgpt-supported-countries) and (3) have a valid ChatGPT Images or ChatGPT Sites account in good standing (each, a “Participant”).  Residents of Afghanistan, American Samoa, Bahrain, Belarus, Bhutan, Cambodia, Central African Republic, Cook Islands, Cuba, Eritrea, Faroe Islands, Federated States of Micronesia, Greenland, Iran, Iraq, Kiribati, Kuwait, Laos, Lebanon, Marshall Islands, Mayotte, Nauru, New Caledonia, Niue, North Korea, Palau, Papua New Guinea, Russia, Samoa, São Tomé and Príncipe, Seychelles, Solomon Islands, Somalia, South Sudan, Sudan, Syria, Timor-Leste, Tonga, Turkmenistan, Tuvalu, Ukraine, Vanuatu, and Wallis and Futuna are not eligible due to shipping restrictions.

Employees, personnel, officers, directors, members, managers, agents, and representatives of OpenAI or its parent or subsidiary companies, affiliates, divisions, representatives, consultants, sub-contractors, suppliers, distributors, legal counsel, prize providers, advertising, public relations, promotional, fulfillment or marketing agencies (collectively, and together with X, the “Released Parties”) and members of their immediate families (defined for these purposes as including any spouse, domestic partner, parents, step-parents, legal guardian, legal ward, children, step-children, grandparent, grandchild, siblings and step-siblings, and each of their respective spouses) and individuals living in the same household as such individuals (whether or not related), are not eligible.

HOW TO ENTER: If you meet the eligibility requirements, complete all the following steps during the Giveaway Period to receive one (1) entry into the Giveaway:

Create a ChatGPT Images generation or ChatGPT Sites link (“Link”). The Link, and all content available via the Link, must comply with these Rules, including the Submission Requirements set forth below.

Login to your personal X account and view the Giveaway Announcement on OpenAI’s X account @ChatGPTapp.

Either make a public comment on the Giveaway Announcement or make a new “tweet” from your X account that contains your Link along with the hashtag #Giveaway and tag @chatgptapp (the "Required Tags" and any such post, an "Entry Post").

Enter your Link and provide all required contact information at https://chatgpt-site-swag-giveaway.openai.chatgpt.site/ (“Entry Form”).

Your Entry Post must be posted, and Entry Form received, during the Giveaway Period to be eligible in this Giveaway. Adding the Required Tags to content previously posted on X will not earn an entry in this Giveaway. In posting an Entry Post, you can include other content (e.g., images, video, and text in addition to the Entry Post (collectively, with the Entry Post, "Entrant Content"). All Entrant Content must comply with these Rules (including, without limitation, the Submission Requirements section below) and the X Terms of Service available at https://help.x.com/en/rules-and-policies. Your Entry Post will not be deemed an entry in the Giveaway until OpenAI verifies that it meets all the Submission Requirements; but the substantive content of the Entry Post will not otherwise affect your chances of winning.

Entry Posts and Entry Forms must be received and identifiable by OpenAI during the Giveaway Period or they will be void. Entries are "received" when X’s database records the completed Entry Post and it is viewable by OpenAI AND OpenAI receives the Entry Form. Other proof of submitting an entry (such as a printed or copied screenshot of your X feed) does not constitute actual receipt of the entry for purposes of this Giveaway. Your Entry Post must remain active on your X account and viewable to OpenAI through winner selection and prize award for this Giveaway. OpenAI may not be able to view purported Entry Posts or otherwise receive entries or detect participation from X users whose accounts are set to "private" (i.e., where user has set their account so that only people the user has approved can view their posts) due to the way X operates its service. It is your responsibility to timely set your account settings so that OpenAI can view your Entry Post. OpenAI is not responsible for misspellings, typographical errors, or other issues that may affect a purported Entry Post from being located using a search to find eligible entries. OpenAI, at its sole discretion, may accept or disqualify a purported Entry Post that omits one of the Required Tags or contains any technically incorrect Required Tag. Purported Entry Posts and/or Entry Forms that are not both visible and received by OpenAI during the Giveaway Period will not be entered into the Giveaway. Purported Entry Posts and/or Entry Forms identified or received outside the Giveaway Period will be void. Each Participant must be the rightful owner of the X and email accounts utilized for entry.

Data Privacy: The personal data collected will be stored, processed, and transmitted in accordance with applicable data protection laws and OpenAI’s Privacy Policy (https://openai.com/policies/privacy-policy/) pursuant to Participant’s agreement to these Rules.

LIMITATIONS: One (1) entry per person/X account/email address. Proof of entry (such as, without limitation, a printed, saved or copied automated receipt confirming submission or a “thanks for entering” screen or message) does not constitute proof of actual receipt of an entry for purposes of the Giveaway. Entries may not be acknowledged or returned and OpenAI will own all entries. OpenAI’s clock will be the official timekeeper for the Giveaway. Those who do not provide the required entry information or abide by these Rules and any other instructions of OpenAI and its representatives may, in OpenAI’s sole discretion, be disqualified and the associated entry void. Attempts made by an individual to submit entries in excess of any limit or otherwise in violation of these Rules by using multiple or false contact information or otherwise may be disqualified. Purported entries that are forged, altered, incomplete, lost, late, misdirected, mutilated, illegitimate, unintelligible, faulty, failed, garbled, or generated by a macro, bot, or other automated means will not be accepted and will be void. Entries or participation made on a Participant's behalf by any other individual, made by any entity or group, or originating at any website or online service other than X, ChatGPT Images, and ChatGPT Sites, including, without limitation, through commercial promotion subscription notification or entering services, will be declared invalid and disqualified for the Giveaway. As a condition of entering the Giveaway, without limiting any other provision in these Rules, each Participant gives consent for OpenAI and its agents to obtain and deliver their name, address, and other information and content to third parties for the purpose of administering the Giveaway and complying with applicable laws, regulations, and rules.

SUBMISSION REQUIREMENTS: Your Entrant Content must meet all of the requirements in these Rules, including the following, or the associated entry will be disqualified:

Sites must be made with ChatGPT Sites in the ChatGPT desktop app and linked and images must be generated by ChatGPT and downloaded.

Entrant Content must NOT depict, identify, or include any person other than the Participant.

All aspects of the Entrant Content must be originally created by and solely owned by you (or be in the public domain). Except for materials in the public domain, all third-party content and content unoriginal to you is prohibited.

Entrant Content must comply with X’s Terms of Use at https://help.x.com/en/rules-and-policies.

Entrant Content must not create or imply any association between OpenAI and any individual or entity or their, or its products or services.

Entrant Content must not contain any commercial or corporate advertising (including, without limitation, corporate logos, brand names, and slogans), recognizable branded products, or commercial artwork other than those of OpenAI that are contained in the Required Tags or may be otherwise incorporated into your Entrant Content.

Entrant Content must not infringe, misappropriate, or violate any rights of any third party including, without limitation, copyright (including moral rights), trademark, trade secret, or rights of privacy or publicity.

Entrant Content must be unpublished and not have been submitted in any other Giveaway, contest, promotion, or competition.

Entrant Content must not include information or content that is false, fraudulent, deceptive, misleading, defamatory, slanderous, libelous (including trade libel), disparaging, unlawfully harassing, threatening, profane, obscene, pornographic, hateful, indecent, inappropriate, or injurious to any Released Party or any other party. Entrant Content must not contain or describe any harmful or illegal activity or content or in any way violate any federal, state, or local laws, rules, or regulations.

Entrant Content must be suitable for presentation in a public forum.

Entrant Content must not suggest, depict, or describe any inappropriate, unlawful, or dangerous behavior or use of OpenAI’s or any other products or services.

You agree that your participation in the Giveaway and agreement to these Rules and any Released Party’s display and use of the Entrant Content permitted under these Rules will not violate any agreement to which you are a signatory or party.

To the fullest extent permitted by applicable law, you agree to indemnify the Released Parties against any and all claims from any third party for any use or reuse by any Released Party of the Entrant Content permitted under these Rules.

OpenAI reserves the right in its sole discretion to disqualify from the Giveaway any Participant whose Entrant Content refers, depicts, or in any way reflects negatively upon a Released Party, the Giveaway, or any other person or entity or does not comply with any provision of these Rules (including the above Submission Requirements), all as determined by OpenAI in its sole discretion.

WINNER SELECTION/NOTIFICATION: The potential winner of the prize will be selected in a random drawing from among all eligible entries received, subject to verification. The drawing will be held within approximately one (1) week after the end of the Giveaway Period.  Once verified, the winner will receive an email using the email address provided in the Entry Form containing instructions on how to redeem the prize within approximately one (1) week of the drawing.  Failure to respond within one (1) week of receipt of email may result in prize forfeiture. In some jurisdictions, to the extent required by applicable law, a winner’s or potential winner’s first initial, last name, and their state and country other general information may be provided or posted on a OpenAI website or elsewhere publicly.  To the extent required and allowed by applicable law, OpenAI will honor requests that winner or potential winner information not be published or posted online. If the potential winner is from Belgium or Canada, they will be required to correctly answer a skill-testing question to be confirmed as the winner.  Failure to correctly answer the skill-testing question will result in forfeiture of the prize. A UK prize winner may object to their surname and county/region being made publicly available. If the prize, prize notification, or Giveaway-related communication is rejected, faulty, or undeliverable; or if winner or potential winner fails to comply with these Rules, the prize may, in OpenAI’s sole discretion, be forfeited and an alternate winner may be selected (time permitting) based on the original method of winner selection or other method that is fair in OpenAI’s sole discretion and no correspondence will be entered into. OpenAI is not obligated to pursue more than three (3) alternate winners for any reason, in which case the prize may go unawarded. OpenAI reserves the right to modify the notification procedures and applicable deadlines for responding in connection with the selection of an alternate potential winner, if any. Upon prize forfeiture or inability to use a prize or portion of a prize, no compensation will be given and OpenAI will have no responsibility or liability to that Participant. To claim a prize, winner must follow the directions in the notification.  Failure to comply with OpenAI’s or its representative’s instructions, or these Rules may, in OpenAI’s sole discretion, result in disqualification from the Giveaway and forfeiture of any prize potentially won. Decisions of OpenAI are final on all matters relating to the Giveaway, including interpretation of these Rules, determining the winner, and awarding of the prize. 

Shipping is not available to Afghanistan, American Samoa, Bahrain, Belarus, Bhutan, Cambodia, Central African Republic, Cook Islands, Cuba, Eritrea, Faroe Islands, Federated States of Micronesia, Greenland, Iran, Iraq, Kiribati, Kuwait, Laos, Lebanon, Marshall Islands, Mayotte, Nauru, New Caledonia, Niue, North Korea, Palau, Papua New Guinea, Russia, Samoa, São Tomé and Príncipe, Seychelles, Solomon Islands, Somalia, South Sudan, Sudan, Syria, Timor-Leste, Tonga, Turkmenistan, Tuvalu, Ukraine, Vanuatu, and Wallis and Futuna are not eligible due to shipping restrictions.

PRIZE, ODDS & APPROXIMATE RETAIL VALUE (“ARV”): One (1) winner, subject to verification, will receive a swag pack of OpenAI “merch” with an ARV of $184.00 USD. Odds of winning depend upon the number of eligible entries received. 

All prize details not specifically stated in the Giveaway Announcement or these Rules will be determined by OpenAI in its sole discretion. All taxes (federal, state, provincial, local, or otherwise), as well as any expenses not specified in these Rules as being provided as part of the prize, are the sole responsibility of the winner. OpenAI is not responsible for, and will not replace any lost, mutilated, or stolen prize or prize component, or any prize/prize component that is undeliverable or does not reach the winner because of incorrect or changed contact information. If the winner does not accept or use the entire prize, the unaccepted or unused part of the prize will be forfeited and OpenAI will have no further obligation with respect to that prize or portion of the prize. OpenAI is not responsible for any inability of any winner to accept or use any prize (or portion of any prize) for any reason. Winner is strictly prohibited from selling, auctioning, trading or otherwise transferring any part of a prize, except with OpenAI’s permission, which may be granted or withheld for any reason in its sole discretion. No transfers, prize substitutions or cash redemptions will be made, except at OpenAI’s sole discretion. OpenAI reserves the right to substitute any stated prize or portion of any prize with another prize or portion of a prize of equal or greater value for any reason, including, without limitation, prize unavailability. No more than the stated prize will be awarded. Participants waive the right to assert, as a cost of winning any prize, any and all costs of verification and redemption or travel to claim or use the prize and any liability and publicity which might arise from claiming or seeking to claim said prize.

License: By entering, except where prohibited by law, each Participant grants to the Released Parties (and their agents, successors and assigns) the irrevocable, sublicensable, absolute and perpetual right and permission to use, edit, modify, copy, adapt, publish, and exploit the Entrant Content in any and all media now existing or hereafter devised (including online) throughout the world, in any language, and in any manner for trade, advertising, promotional, commercial, or any other purposes, without further review, notice, approval, consideration, or compensation beyond the opportunity to win a prize in this Giveaway. Each Participant waives and releases the Released Parties from any and all claims that Participant may now or hereafter have in any jurisdiction based on "moral rights" or "droit moral" or unfair competition with respect to the Released Parties’ exploitation of any Entrant Content without further notification or compensation to Participant of any kind, and agrees not to instigate, support, maintain, or authorize any action, claim, or lawsuit against the Released Parties, each of their licensees, or any other person in connection with this Giveaway, on the grounds that any use of any Entrant Content or element thereof or derivative works therefrom in accordance with this license infringes or violates any of Participant’s rights (including MORAL RIGHTS) therein.

Each Participant hereby acknowledges and agrees that the relationship between Participant and each of the Released Parties is not a confidential, fiduciary, or other special relationship, and that the Participant’s decision to submit Entrant Content for purposes of the Giveaway does not place any of the Released Parties in a position that is any different from the position held by members of the general public with regard to elements of the Entrant Content, other than as set forth in these Rules. Each Participant understands and acknowledges that OpenAI has wide access to ideas, images, and other creative materials. Each Participant also acknowledges that many ideas or images may be competitive with, similar to, or identical to theirs. Each Participant acknowledges and agrees that such Participant will not be entitled to any compensation as a result of OpenAI’s use of any such similar or identical material that has or may come to OpenAI from other sources. Each Participant acknowledges and agrees that OpenAI does not now, and will not have in the future, any duty or liability (direct or indirect; vicarious, contributory, or otherwise) with respect to the infringement or protection of the Participant’s copyright in and to their Entrant Content or its constituent elements. Each Participant acknowledges that, with respect to any claim by Participant relating to or arising out of a Released Party’s actual or alleged exploitation or use of any Entrant Content or other material submitted in connection with the Giveaway, the damage, if any, thereby caused to the applicable Participant will not be irreparable or otherwise sufficient to entitle such Participant to seek injunctive or other equitable relief or in any way enjoin the production, distribution, exhibition, or other exploitation of any Released Party property or product, and Participant’s rights and remedies in any such event are strictly limited to the right to recover damages, if any, in an action at law.

LIMITATION OF LIABILITY: To the fullest extent permitted under applicable law, each Participant agrees to release, hold harmless, and indemnify each of the Released Parties from and against any liability whatsoever for injuries or damages of any kind sustained in connection with the acceptance, use, misuse, or awarding of the prize or while preparing for, participating in, and/or traveling to or from any prize- or Giveaway-related activity including, without limitation, any injury, damage, loss, death or accident to/of person or property. Winner agrees that the prize is provided as-is without any warranty, representation, or guarantee, express or implied, in fact or in law, whether now known or hereinafter enacted, relative to the use or enjoyment of the prize, including, without limitation, its quality, merchantability, or fitness for a particular purpose.  

To the fullest extent permitted by applicable law, each Participant understands and agrees that all rights under section 1542 of the Civil Code of California and any similar law of any state or jurisdiction of the United States are expressly waived by him/her. Section 1542 reads as follows:

“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

ADDITIONAL DISCLAIMERS: Released Parties are not responsible and/or liable for any of the following, whether caused by a Released Party, Participant, or human error: entries that are submitted by illegitimate means (such as, without limitation, by an automated computer program) or entries in excess of any stated limit; any lost, late, incomplete, illegible, unintelligible, garbled, mutilated, or misdirected entries, email, mail, or Giveaway-related correspondence or materials; any error, omission, interruption, defect or delay in transmission or communication; viruses or technical or mechanical malfunctions; interrupted or unavailable cable or satellite systems; errors, typos, or misprints in these Rules or the Giveaway Announcement, in any Giveaway-related advertisements, or other materials; failures of electronic equipment, computer hardware, or software; lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications or entry information. Released Parties are not responsible for electronic communications that are undeliverable or do not reach a Participant because of any form of active or passive filtering of any kind, or insufficient space in a Participant’s account or inbox to receive messages. Released Parties are not responsible, and may disqualify you, if your contact information does not work or is changed without prior written notice to OpenAI. Without limiting any other provision in these Rules, Released Parties are not responsible or liable to any Participant or winner or any person claiming through such Participant or winner for failure to supply the prize or any part of a prize in the event that any of the Giveaway activities or Released Parties’ operations or activities are affected by any cause or event beyond the sole and reasonable control of the applicable Released Party (as determined by OpenAI in its sole discretion), including, without limitation, by reason of any acts of God, any action, regulation, order or request by any governmental or quasi-governmental entity (whether or not the action, regulations, order or request proves to be invalid), equipment failure, threatened or actual terrorist acts, air raid, blackout, act of public enemy, earthquake, war (declared or undeclared), fire, flood, epidemic, pandemic, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any law, rule, regulation, action, order or request adopted, taken or made by any federal, state or local governmental or quasi-governmental entity (whether or not such governmental act proves to be invalid), or any other cause, whether or not specifically mentioned above.

GENERAL RULES: All Participants, as a condition of entry into the Giveaway, agree to be bound by these Rules and the decisions of OpenAI. Failure to comply with these Rules may result in disqualification from the Giveaway. Participants further agree not to damage or cause interruption of the Giveaway and/or prevent others from entering and/or participating in the Giveaway. OpenAI reserves the right to restrict or void entries or participation from any IP address or other identifiable source if any suspicious entry and/or participation is detected. OpenAI reserves the right, in its sole discretion, to void entries of any Participants who OpenAI believes have attempted to tamper with or impair the administration, security, fairness, or proper play of the Giveaway. OpenAI’s failure to, or decision not to, enforce any provision in these Rules will not constitute a waiver of that or any other provision. In the event there is an alleged or actual ambiguity, discrepancy, or inconsistency between disclosures or other statements contained in any Giveaway-related materials, the Giveaway Announcement, and/or these Rules (including any alleged discrepancy or inconsistency within these Rules), it will be resolved by OpenAI in its sole discretion and no correspondence will be entered into. Participants waive any right to claim ambiguity in the Giveaway structure, any Giveaway materials, Giveaway Announcement, Entry Form, or these Rules. If OpenAI determines, at any time and in its sole discretion, that a winner or potential winner is disqualified, ineligible, in violation of these Rules, or engaging in behavior that OpenAI deems obnoxious, inappropriate, threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, OpenAI reserves the right to disqualify that winner or potential winner, even if the disqualified winner or potential winner may have been notified or displayed or announced anywhere. The invalidity or unenforceability of any provision of these Rules will not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules will otherwise remain in effect and will be construed in accordance with their collective terms as if the invalid or illegal provision were not contained in these Rules. If the Giveaway is not capable of running as planned for any reason, OpenAI reserves the right, in its sole discretion, to cancel, modify or suspend the Giveaway and award the prize from eligible entries received prior to cancellation, modification, or suspension or as otherwise deemed fair and appropriate by OpenAI. If any person supplies false information, obtains entries by fraudulent means, or is otherwise determined to be in violation of these Rules in an attempt to obtain any prize, OpenAI may disqualify that person and seek damages from them and that person may be prosecuted to the full extent of the law. No Released Party will have any responsibility or liability for any dispute regarding any Participant, including the identity of any individual participating on behalf of a business or organization, the affiliation, employment, membership, and/or agency of individuals of a business or organization, or the distribution of any prize. In the event of a dispute regarding an entry or participation (including those regarding the identity or affiliation, employment, membership, and/or agency of an individual or Participant, who submitted an entry, and/or who should receive a prize) cannot be resolved to OpenAI’s satisfaction, in its sole discretion, the entry will be deemed ineligible and the Participant disqualified. Caution: Any attempt to damage any online service or website or to undermine the legitimate operation of the Giveaway may violate criminal and civil laws. If such an attempt is made, OpenAI may disqualify any Participant (or purported Participant) making such attempt and may seek damages to the fullest extent permitted by law.

DISPUTES/GOVERNING LAW: Except where prohibited, as a condition of participating in the Giveaway, each Participant agrees that any and all disputes that cannot be resolved between the Participant and any Released Party, claims and causes of action arising out of or connected with the Giveaway or the prize awarded, or the determination of a winner must be resolved individually, without resort to any form of class action. 

The Giveaway, these Rules, and any dispute arising under or related to the Giveaway and/or Rules (whether for breach of contract, tortious conduct or otherwise) will be governed, construed, and interpreted under the internal laws of the state of California, USA, without reference or giving effect to its conflicts of law principles or rules that would cause the application of any other state’s laws and, if that is not possible, then the laws of the United Kingdom. All disputes, claims or demands that relate to the Giveaway or these Rules will be resolved by the dispute resolution and arbitration terms set forth at https://openai.com/policies/terms-of-use/ which are incorporated herein by reference. Unless prohibited by applicable law, you waive all objections to jurisdiction and venue in these courts and hereby submit to the jurisdiction of those courts. If required under applicable law, nothing herein will limit the right of any participant to bring proceedings (including third party proceedings) against OpenAI in a court of competent jurisdiction located within the Participant’s jurisdiction (as applicable). For German residents, Der Rechtsweg ist ausgeschlossen.

WINNER’S LIST/OFFICIAL RULES: To find out the first initial, last name, and country of the winner, send an email within 90 days of the Giveaway Period to support@openai.com with the subject: Twitter Giveaway Winner List Request. One (1) winner information request per person/email address will be fulfilled.  For a copy of these Rules, no later than the end of the Giveaway Period either print out these pages or send an email to support@openai.com with the subject: Twitter Giveaway Official Rules Request. support@openaib.com is OpenAI’s email for the purposes of the Giveaway. 

THIRD PARTIES: Reference within the Giveaway Announcement or any Giveaway-related materials to any third party in connection with prizes and/or third-party websites, products, or services are for reference and identification purposes only and not intended to suggest endorsement, sponsorship, or affiliation with OpenAI or the Giveaway.
